Sra. Lydia, longtime member of Causa Justa Just Cause (CJJC), is mourning the untimely death of her son, Jose “Nick” Piña Cardenas to the carceral system. Nick died after being detained at the notoriously deadly Santa Rita jail.  Nick, 30 and the father of five, lost his life under questionable circumstances.

Despite the jail denying this being an in-custody death, community members know this is now at least the 59th person who’s died from injuries while in-custody at the jail since 2014 and at least the 2nd person who has died since the jail was placed under a controversial consent decree in February 2022.

Independent Investigation

The findings of the coroner are under the auspices of the Sheriff’s authority. Sra. Lydia wants an independent coroner investigation so that the sheriff department isn’t investigating its own in-custody deaths.

“What happened? asks Sra. Lydia, “Where are the videos of the incident? How do people keep dying in that jail? This needs to end. We need justice so that those who are incarcerated don’t end up dead.”

Nick’s family is now searching for answers to receive the peace that they deserve to lay their relative to rest. After the difficulties faced from the struggles of the pandemic, Nick was rebuilding his life to be the best father and son for his family. That opportunity was taken from him and now the family is dealing with inconsistent reports about his treatment while in custody.

“I’ve seen this happen in other parts of the country and the same thing is happening here. Our lives aren’t valued and folks think they can just throw us away. What’s NOT going to happen is to let another mother lose her son and nothing be done without accountability and without justice.  We won’t rest until the Santa Rita Jail is closed, and there is justice for Nick,”  said Shaketa Redden, Executive Director of CJJC

Public Records

Public records show that several jail deputies used physical force and restraints against Nick just hours after arriving at the jail on May 17th. He had been taken to a holding cell and was waiting to be transferred.

That same night, he left Santa Rita Jail in an ambulance to ValleyCare Medical Center in Dublin.

At no time did Santa Rita personnel inform his family that he had been transferred to the medical center the same day he was detained, or that force was used against him l. His family didn’t find out he was in the hospital until nine days later.

Sra. Lydia used to attend and support actions calling for the closure of Santa Rita jail. “I never thought I would one day be dealing with this myself,” she tells us.

Nick was pronounced dead on June 7th. Despite the use of force by deputies while detained, the Alameda County Sheriff’s office is not treating this as an in-custody death. Sra. Lydia is trying to come up with the immense costs associated with her son’s death..  Funds raised through this Gofund me will support costs associated with  an independent autopsy, an investigation, and funeral expenses.

“The whole system is responsible for the continuous deaths and state violence happening at Santa Rita Jail, from the deputies to the Division Commander, up to the Sheriff,” says Jose Bernal, Organizing Director at Ella Baker Center for Human Rights.

Ayuda a encontrar justicia para Nicky

Sra. Lydia, miembra desde hace mucho tiempo de Causa Justa Just Cause (CJJC), está de luto por la muerte prematura de su hijo, José “Nick” Piña Cárdenas, al sistema carcelario. Nick murió después de ser detenido en la cárcel de Santa Rita. Nick, de 30 años y padre de cinco hijos, perdió la vida en circunstancias cuestionables.

A pesar de que la cárcel niega que se trate de una muerte bajo custodia, los miembros de la comunidad saben que ahora es al menos la persona número 59 que muere a causa de lesiones mientras estaba bajo custodia en la cárcel desde 2014 y al menos la segunda persona que muere desde que se colocó la cárcel bajo un controvertido decreto de consentimiento en febrero de 2022.

Investigación independiente

El forense está bajo los auspicios de la autoridad del alguacil. Sra. Lydia quiere una investigación forense independiente para que el departamento del sheriff no investigue sus propias muertes bajo custodia.

“¿Qué sucedió? pregunta la Sra. Lydia, “¿Dónde están los videos del incidente? ¿Cómo sigue muriendo gente en esa cárcel? Esto tiene que terminar. Necesitamos justicia para que los que están encarcelados no terminen muertos”.

La familia de Nick ahora está buscando respuestas para recibir la paz que se merecen para dejar descansar a su pariente. Después de las dificultades que enfrentó por la pandemia, Nick estaba reconstruyendo su vida para ser el mejor padre e hijo para su familia. Esa oportunidad le fue arrebatada y ahora la familia está lidiando con informes inconsistentes sobre el trato que recibió mientras estuvo bajo custodia.

“He visto que esto sucede en otras partes del país y lo mismo está sucediendo aquí. Nuestras vidas no son valoradas y la gente piensa que simplemente pueden tirarnos. Lo que NO va a pasar es que otra madre pierda a su hijo y no se haga nada sin rendición de cuentas y sin justicia. No descansaremos hasta que se cierre la Cárcel de Santa Rita y se haga justicia para Nick”, dijo Shaketa Redden, Directora Ejecutiva de CJJC

Registros públicos

Los registros públicos muestran que varios agentes de la cárcel usaron fuerza física y restricciones contra Nick solo unas horas después de llegar a la cárcel. el 17 de mayo. Lo habían llevado a una celda de detención y estaba esperando ser trasladado.

Esa misma noche, salió de la cárcel de Santa Rita en una ambulancia hacia el Centro Médico ValleyCare en Dublín.

En ningún momento personal de Santa Rita informó a su familia que había sido trasladado al centro médico el mismo día de su detención, ni que se había hecho uso de la fuerza en su contra. Su familia no supo que estaba en el hospital hasta nueve días después.

Sra. Lydia asistía y apoyaba acciones que pedían el cierre de la cárcel de Santa Rita. “Nunca pensé que algún día estaría lidiando con esto yo misma”, nos dice.

Nick fue declarado muerto el 7 de junio. A pesar del uso de la fuerza por parte de los agentes mientras estaban detenidos, la oficina del alguacil del condado de Alameda no está tratando esto como una muerte bajo custodia. Sra. Lydia está tratando de afrontar los inmensos costos asociados con la muerte de su hijo. Los fondos recaudados a través de este Gofund me financiarán los costos asociados con una investigacion independiente , y los gastos del funeral.

“Todo el sistema es responsable de las continuas muertes y violencia estatal que ocurren en la Cárcel de Santa Rita, desde los alguaciles hasta el Comandante de División, hasta el Sheriff”, dice José Bernal, Director de Organización del Centro de Derechos Humanos Ella Baker.
