When the Pelayo-Valenzuela family first came to San Francisco in 1996 they struggled to find decent and affordable housing.
Norma and Faustino lived in expensive yet tiny studios, shared cramped units with other families while having restricted access to the kitchen and other essentials.”We worked day and night to survive,” says Norma.
When they were finally able to move into their own apartment in the Bayview the family was elated. “After struggling for so long, we were presented with an opportunity to move into this Bayview District apartment in 1998 where we are still living, she adds.
Now, after almost 20 years of living happily in their apartment and where their children were born, where they have laid down deep roots of family, friends, church, work, Norma and her husband Faustino are facing the fight of their lives–the sustainability of their family — keeping a roof over their heads and their family stable. They have had to fight off two attempted evictions, and their family is dealing with what they say feels like a never ending battle to stay in their home.
In 2005 Kelly & Dien Nguyen as Sylvan LLC and Lisa Nguyen set their sights on a nice little parcel – an apartment complex with eight units – and purchased Norma and Faustino’s building.
After a continuing strained relationship with the new owners, Norma and Faustino came to Causa Justa :: Just Causes’ tenant rights clinic in 2010 seeking support because Nguyen was looking to change the terms of their contract.
The issues did not end there. Norma and Faustino recall years of vigilantly warding off attempted illegal rent increases in the form of “water payments” and of having to advocate for themselves as asks for neglected and necessary repairs.
But as tenants in San Francisco know all too well, this is the price we often pay for relatively affordable housing near schools and needed community resources.
In June 2016 Nguyen set her sights on the second longest tenants living in the eight-unit building: the Pelayo-Valenzuela family where she served them with an Owner Move-In Eviction (OMI). This, after a botched attempt to evict an elderly renter who has had the longest tenancy. There have been several new tenancies over the years, none of which any of the landlords attempted to move in.
Norma and Faustino received that OMI while their two young sons were on summer vacation and the whole family was enjoying some much needed rest from the hustle and bustle of two busy academic schedule. “They really know how to ruin and traumatize children’s vacations, they do not mind leaving my family homeless and affecting the academic study of my children,” says Faustino.
While heartbreaking, Norma and Faustino’s story is all too common – Owner Move-In evictions have reached a crisis level in San Francisco as they become the new go-to eviction scheme.
While the city is responding, passing new protections OMI for tenants facing OMI’s, families like Pelayo-Valenzuela still need their community to stand with them. Even after having won the first leg of this fight with the support of Causa Justa :: Just Cause and the Tenderloin Housing Clinic, their home is still in peril. Their notice has now reached the Unlawful Detainer stage and the case is going to court.
Norma and Faustino’s community involvement is deep and well-recognized. From their work with different community organizations, being deeply involved in their sons schools and afterschool programs, and even having used their story to help pass the legislation that will protect tenants from unjust OMI’s like the one they are facing.
They are the everyday people that make San Francisco great and just as they have fought for countless of other folks in the community, it is time that the community stand with Faustino and Norma as they fight against their eviction. Familia Lucha en Contra de Segundo Desalojo por Mudanza de Dueño en Hogar de Largo Plazo en el Bayview
Cuando la familia Pelayo-Valenzuela primero llegaron a San Francisco en 1996 lucharon para poder encontrar vivienda digna y asequible.
Norma y Faustino vivieron en estudios pequeños pero caros, compartiendo unidades apretadas con otras familias mientras se les restringía el acceso a la cocina y otras esenciales. “Trabajamos dia y noche para sobrevivir.” dice Norma.
Cuando pudieron finalmente obtener su propio apartamento en el Bayview la familia estaba eufórica. “Después de batallar por tanto tiempo, en 1998 se nos presentó la oportunidad para movernos al apartamento en el Distrito del Bayview donde todavía vivimos,” ella agrega.
Ahorra, después de casi 20 años de vivir felizmente en su apartamento, donde nacieron sus hijos, donde establecieron conexiones profundas de familia, amistades, iglesia y trabajó Norma y su esposo Faustino enfrentan la lucha de sus vidas – la estabilidad de su familia- manteniendo un techo sobre sus cabezas y a su familia estable. Han tenido que luchar dos desalojos, y ahora su familia está enfrentando lo que parece una lucha sin fin por.

Los problemas no terminaron ahi. Norma y Faustino recuerdan años de vigilancia protegiéndose en contra de intentos a aumentar su renta ilegalmente en formas de “pagos de agua”, y de tener que abogar por sí mismos mientras peticiones a hacer reparaciones necesarias fueron ignoradas.
Pero, como los inquilinos en San Francisco lo saben muy bien, con demasiada frecuencia este es el precio que pagamos por tener vivienda relativamente asequible cerca de nuestra escuelas y recursos comunitarios.
Junio del 2016, Nguyen fijó su mirada a la familia Pelayo-Valenzuela – los inquilinos con el segundo más antiguo inquilinato en el edificio – y les sirvió un Desalojo por Mudanza de Dueño (OMI por sus siglas en inglés).
Esto fue después de un intento fallido de desalojar a un inquilino de tercera edad con el inquilinato más antiguo del edificio. Han habido varios inquilinatos nuevos a través de los años, pero el propietario nunca intentó servirlos con un aviso de mudanza.
Norma y Faustino recibieron el aviso de OMI mientras su hijos estaban en vacaciones de verano y toda la familia estaba disfrutando de un descanso muy buen merecido del bullicio de dos ocupados calendario académico. “Realmente saben cómo arruinar y traumar las vacaciones de los niños, no les importa dejar mi familia sin hogar y afectar el estudio académico de mis hijos,” dice Faustino.
Aunque es desgarrador, la historia de Norma y Faustino es demasiado común- los Desalojos por Mudanza de Dueno han alcanzado un nivel de crisis en San Francisco ya que se ha convertido en la nueva esquema desalojo.
Mientras que la ciudad está respondiendo, pasando nuevas protecciones para inquilinos enfrentando desalojos, familias como Pelayo-Valenzuela todavía necesitan el apoyo de su comunidad. Incluso después de haber ganado la primera etapa de esta pelea con el apoyo de Causa Justa :: Just Cause y la Clínica de Vivienda del Tenderloin su casa sigue en peligro. Su notificación ha llegado a la fase de detención ilegal y el caso va a corte.
La participación comunitaria de Norma y Faustino es profunda y bien reconocida. De su trabajo con diferentes organizaciones comunitarias, estando profundamente involucrados en la escuela de sus hijos y los programas después de clases, e incluso usando su historia para ayudar a aprobar la legislación que protegerá a inquilinos de enfrentando desalojos de OMI.
Norma y Faustino son los héroes de cada dia que siempre mejoran a San Francisco y así como han luchado por un sinnúmero de otras personas en la comunidad, es hora de que la comunidad esté con ellos mientras luchan contra su desalojo.
